By accessing or using FairTab ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. FairTab reserves the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.
2. Description of Service
FairTab is a community-powered platform that allows users to submit, review, and access information about restaurant fees and tip prompts. FairTab provides transparency to diners by aggregating and displaying verified receipt data, including service charges, surcharges, and default tip percentages.
3. User Accounts
To submit receipts or contribute to the platform, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying FairTab immediately of any unauthorized use of your account
- Providing accurate and truthful information during registration
4. User Submissions
By submitting a receipt or restaurant information to FairTab, you represent and warrant that:
- The information you submit is accurate and truthful to the best of your knowledge
- You are the person who received the receipt or have authorization to submit it
- The receipt is from a real dining experience and has not been altered or falsified
- You grant FairTab a non-exclusive, royalty-free license to use, display, and process the submitted content for the purpose of operating the Service
FairTab reserves the right to reject, remove, or modify any submission that violates these terms or that our moderation team determines to be inaccurate, fraudulent, or otherwise inappropriate.
5. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fabricated receipt information
- Attempt to manipulate restaurant scores through fraudulent submissions
- Use the Service to defame, harass, or harm any restaurant or individual
- Scrape, crawl, copy, harvest, or systematically extract any data from FairTab without prior written permission
- Use automated bots, scripts, spiders, or crawlers to access, query, or collect data from the Service
- Access FairTab through any automated means, including but not limited to scripts, bots, scrapers, or data mining tools
- Reproduce, republish, redistribute, sell, license, or commercially exploit any FairTab data, scores, fee information, or tip prompt data
- Use FairTab data to build, train, or inform any competing product, service, database, or application
- Make unauthorized API calls or programmatic requests to FairTab systems
- Attempt to circumvent the moderation or review systems
- Submit receipts belonging to others without authorization
5a. Data Ownership and Permitted Use
All restaurant fee data, FairTab Scores, tip prompt information, and related content displayed on FairTab is the exclusive property of FairTab. This data is made available solely for individual, non-commercial use by visitors browsing restaurant transparency information for personal dining decisions.
Any commercial use of FairTab data — including aggregation, resale, integration into third-party products, or use in competitive analysis — is strictly prohibited without a written license agreement with FairTab. Violations may result in legal action.
FairTab reserves the right to block, restrict, or take legal action against any individual or entity found to be scraping, harvesting, or otherwise misappropriating FairTab data.
6. Accuracy of Information
FairTab strives to provide accurate and up-to-date information, but we make no warranties regarding the completeness, accuracy, or reliability of any restaurant data on the platform. Restaurant fee practices can change, and scores are based on community submissions. FairTab is not responsible for decisions made based on information displayed on the platform.
7. Accuracy of User-Submitted Data
FairTab is a community-powered platform. Scores, fee data, and tip prompt information are derived from submissions made by real users based on their dining experiences. While we review flagged submissions and work to maintain data quality, FairTab cannot guarantee that every submission is complete, current, or free from error.
Scores reflect reported data at a point in time and may not represent a restaurant's current fee structure. Restaurants may change their fees or pricing at any time — fees can be added, removed, or modified at the restaurant's discretion. FairTab encourages users to submit updated information when they notice discrepancies, and scores are recalculated as new verified submissions are received.
FairTab makes no warranty, express or implied, that any score, fee percentage, or tip prompt displayed on the platform is exact or guaranteed. Users should treat FairTab scores as one helpful transparency tool among many when making dining decisions, not as verified statements of fact.
FairTab scores and data are generated algorithmically from community submissions and do not constitute professional, legal, financial, or consumer advice of any kind.
7a. Restaurant Dispute and Correction Process
FairTab acknowledges that restaurant fee practices change over time and that community-submitted data may occasionally be incomplete, outdated, or inaccurate. Restaurants who believe their listing contains inaccurate information are encouraged to contact FairTab directly at hello@getfairtab.com to request a review.
FairTab will make reasonable efforts to review disputed listings and update scores where sufficient evidence of inaccuracy is provided. However, FairTab reserves the right to maintain scores that are supported by verified community submissions and is under no obligation to remove or alter listings based solely on a restaurant's request.
Submitting a dispute or correction request does not guarantee any change to a restaurant's listing or score. FairTab's determination regarding any dispute is final.
8. Intellectual Property
The FairTab name, logo, platform design, and proprietary scoring methodology are the exclusive intellectual property of FairTab. The FairTab name and shield logo are pending trademark registration with the United States Patent and Trademark Office (USPTO). FairTab™ is a trademark of FairTab. Unauthorized use, reproduction, or imitation of FairTab's branding, name, or platform is strictly prohibited.
The FairTab Score (FTS) methodology, scoring algorithm, weighting system, and related systems are proprietary and confidential. Reproduction, reverse engineering, imitation, or derivation of the FairTab scoring system is prohibited without express written consent.
The compiled database of restaurant fee data, tip prompts, and FairTab Scores constitutes a proprietary database protected under applicable intellectual property law. Unauthorized extraction or use of substantial portions of this database is prohibited.
9. Restaurant Photos
Restaurant photos displayed on FairTab are sourced from Google Maps and are subject to Google's terms of service and usage policies. FairTab does not own, control, or independently verify these photos.
FairTab makes no representations or warranties regarding the accuracy, completeness, or currentness of any restaurant photos displayed on the platform. Photos may not reflect the current appearance, layout, menu, ownership, or operating status of a restaurant.
Photos may depict individuals, staff, patrons, or other persons. FairTab is not liable for the appearance, likeness, or depiction of any individual in restaurant photos sourced from Google Maps. If you believe a photo is inappropriate, please contact us at [email protected].
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. FairTab does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, FairTab shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, even if FairTab has been advised of the possibility of such damages.
11. Termination
FairTab reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

3. Receipt Images
Receipt images you upload are stored securely and used solely for the purpose of verifying fee and tip information. Receipt images are not shared publicly and are accessible only to FairTab staff and administrators.
We recommend that you redact or cover any sensitive personal information on receipts (such as full card numbers or signatures) before uploading.

- Service providers: We use Supabase for database and storage, and Google Cloud Vision for OCR processing. These providers are bound by their own privacy policies and data processing agreements.

- Business transfers: If FairTab is acquired or merges with another company, your information may be transferred as part of that transaction.
5. Public Information
The following information may be displayed publicly on FairTab:

Your name, email address, and individual receipt submissions are never displayed publicly.
6. Data Security
We implement industry-standard security measures to protect your information, including encrypted data storage, secure HTTPS connections, and access controls. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
7. Data Retention
We retain your account information for as long as your account is active. Receipt submissions and associated data are retained to maintain the integrity of restaurant scores. You may request deletion of your account and associated data by contacting us.

Depending on your location, you may have the right to:
